Llei 8/2026, de 2 de juliol, de l'erradicació de l'amiant (Catalonia's asbestos eradication law) came into force on 3 October 2026. Its article 21 requires that, in every sale or rental of a property in Catalonia, the seller or landlord hands over a certificate stating at least the presence or absence of visible asbestos, its state of repair and the potential risk. The law leaves the details of the document, and who may issue it, to a later regulation. Outside Catalonia it isn't required to sell or rent, but it's advisable before selling, renting or renovating a property built before 2002.
Until that regulation arrives, the Catalan Waste Agency (ARC) has published a provisional template and a set of FAQs. Under that template, it is signed by architects, building engineers and engineers within their areas of competence, and the inspection is visual. In the template's own words: "Visual inspection only, with no tests or sampling; limited to visible and accessible elements. It does not prevent the sale or the rental." What does that mean in practice? The technician checks what can be seen and reached without building work: downpipes, tanks, accessible false ceilings, accessible roofs, cladding. Nothing is broken and no samples are taken. If they find a suspect material, they describe it, assess its condition and risk, and tell you what to do. The result doesn't block the sale or the rental.
Are there penalties in Catalonia? The law provides for fines for not handing over the certificate; opinions differ on whether they already apply before the implementing regulation is approved. So we won't try to scare you with fines: the real reason to get it right is that the notary, the buyer and the tenant will ask you for it.
